Terms of Service

1. Acceptance of Terms

These Terms are between you and Alan David Vega, a California sole proprietor operating Minty ("Minty"). By accessing or using Minty TCG ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Minty TCG provides a market terminal and analytics platform for trading card games including Pokémon and One Piece TCG. Our services include:

• Market data: timestamped prices, movers, liquidity, and volatility
• Search tools, watchlists, and portfolio analytics
• Comps discovery, price ranges, and market context
• Experimental card image and condition-analysis tools
• Market intelligence and sentiment insight

3. Important Disclaimers

You acknowledge that trading card values are highly volatile and can fluctuate significantly. Any decisions you make based on our Service are solely your responsibility.

4. Eligibility and User Accounts

The Service is available only to United States residents who are at least 18 years of age. Minty records your self-attestation for this eligibility gate; it does not collect your full birth date to verify age.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

5. Subscription and Payment

Minty currently offers a free tier, and no paid service has launched. If the first paid beta is activated, Basic will be offered through Apple in-app purchase only. The approved snapshot price is $7.99/month. Basic has no free trial, introductory offer, or annual plan. It is purchased and managed through Apple subscriptions in the iOS product.

• The exact Apple price, currency, billing period, and renewal terms appear before purchase
• Apple subscriptions renew automatically until canceled through Apple
• Deleting a Minty account does not cancel Apple billing
• Cancellation, refunds, and billing status remain governed by Apple and applicable law

6. User Obligations and Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Use the Service to compete with us or build a competing service

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by Alan David Vega, operating Minty, and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR ANY LOSSES RESULTING FROM YOUR USE OF MARKET SIGNALS, PRICING CONTEXT, OR ANALYTICS

9. Indemnification

You agree to indemnify and hold harmless Alan David Vega, operating Minty, and Minty's contractors and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• At our sole discretion, with or without cause

Upon termination, your right to use the Service will cease immediately. We are not obligated to provide refunds or prorated amounts for terminated accounts.

11. Dispute Resolution

California law governs these Terms, subject to non-waivable consumer protections. State and federal courts located in Los Angeles County, California are the default forum for disputes. Eligible claims may be brought in small claims court, and any legally required alternative forum or other non-waivable right remains available.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. When affirmative acceptance is required, Minty will present the updated Terms and record your agreement to that exact version.
